The Seller undertakes to respond to written or electronic correspondence by the Buyer without delay, within a period of four working days at the latest.

GENERAL PROVISIONS

These terms and conditions apply to purchases in an online store www.tajemstvijamu.czThe conditions specify the rights and obligations of the seller, who is Lenka Eliášová, with the registered office of the Cooperative 797, Ústí nad Orlicí, 562 06, ID 05434891 (hereinafter the seller), and the buyer (hereinafter the buyer).All contractual relationships are concluded in accordance with the law of the Czech Republic. If the consumer is a party to the contract, the relationship is governed by the business conditions not governed by the Civil Code (Law No. 89/2012 Coll.) and the Consumer Protection Act (Law No. 634/1992 Coll.). If the contractor is a businessman, the relationship is governed by the commercial conditions not regulated by the Civil Code (Act No. 89/2012 Coll.).

By submitting a binding order, the buyer confirms that he has become familiar with these terms and conditions of sale and that he agrees with both documents. The buyer is also informed about the possibility of becoming familiar with the terms and conditions of the order before sending the order.

Definition of concepts

Consumer contract: Contract of purchase, work or other contract under the Civil Code if the Contracting Parties are on the one hand the consumer and on the other hand the supplier (seller).

Supplier/seller: Person who acts in the course of his business or other business when concluding and fulfilling the contract. He is an entrepreneur who directly or through other entrepreneurs supplies the buyer products or provides services.

Consumer: Person who does not act in the course of his business or other business when concluding and performing a contract. He is a natural or legal person who purchases goods or uses services for purposes other than those for business in such goods or services.

Purchase contract: Buyer’s order is a draft purchase contract. The purchase contract is concluded at the moment of delivery of the binding consent of the seller with the order of the buyer (binding confirmation of the order by the seller). From this moment between the buyer and the seller arise mutual rights and obligations.

COMMUNICATION UNDER ARTICLE 1820 AND THE FOLLOWING CITIZENS

The seller shall indicate that:

  • The cost of means of communication at a distance is not different from the basic rate.
  • It requires payment of the purchase price before the buyer takes over the performance, unless the buyer has selected the possibility of payment on delivery in the order.
  • Prices of goods and services are on the website operated by the seller www.tajemstvijamu.cz The costs of the supply of goods or services vary according to the chosen method and the provider of transport and the method of payment.
  • If the buyer is a consumer, the buyer has the right to withdraw from the contract (unless otherwise specified), within a period of fourteen days running:
    • For the purchase contract, from the date of receipt of the goods,
    • For a contract of several types of goods or of several parts, from the date of receipt of the last supply of goods.

OBJECTIVE

– Buyer’s order is a proposal to conclude a purchase contract. By sending binding consent to the seller with the order is the purchase contract concluded.


– By sending the order, the buyer confirms that he has become familiar with these terms and conditions and that he agrees with them.

All prices are final and including VAT unless otherwise specified. The seller is not a VAT payer.

METHOD OF PAYING AND SUBSIDY CONDITIONS

Payment options for ordered goods are as follows:

  • Bank transfer in the Czech Republic to account: 2801956909/2010
  • or by transfer to account: 2401956918/2010 (for patby in EUR)

If the goods are paid by transfer, the buyer undertakes to pay the purchase price within 7 days of sending the order. Payment means crediting the amount of the purchase price to the seller’s account.

If the full amount of the purchase price is not credited to the seller’s account within seven days of sending the order, the buyer is deemed to have withdrawn from the contract. Any delay with the payment is obliged the buyer to notify the seller by e-mail to Lenka@tajemstvijamu.cz or by phone to +420 775 999 498 to prevent withdrawal.

Use the order number as a variable symbol when entering the payment. Payment instructions after sending your order will arrive at your e-mail.

If the purchase contract is validly concluded, the ordered goods will be sent to the buyer within 10 days of delivery of the order to the seller, provided that the full amount of the purchase price will be credited to the seller’s account when the purchase price is paid.

If the ordered goods cannot be sent within the specified deadline, the seller will immediately inform the buyer about this and communicate the replacement delivery date or offer another comparable product. In this case, the seller will request the buyer’s consent and the buyer has the right to withdraw from the contract in case of disagreement.

RETURNING OF GOODS

As a consumer, you have the right to return the purchased goods within 14 days (depart from the contract). For hygienic reasons and because the damaged packaging devalues the price of the products, it is not possible to return the goods already unpacked. The goods can only be returned in original intact packaging. The buyer is entitled to withdraw from the contract at any time prior to delivery of the goods.

If you buy goods as a company or a businessman (i.e. your VAT number is on the tax document), the right of withdrawal does not arise.

The time limit for returning the goods lasts 14 calendar days and starts on the following calendar day after the goods have been taken over. In order to comply with the time limit for returning the goods, it is crucial when withdrawal from the contract is delivered to the seller.

The seller is obliged to refund the amount fully corresponding to the price of the goods to the buyer within 14 days of the withdrawal of the contract in the same way as the payment was accepted.

Exceptions: The right to withdraw from the contract shall not apply to contracts for the supply of goods adjusted to the consumer’s wishes or to his/her person.

RETURN PROCEDURE
  1. First send information about withdrawal to e-mail Lenka@tajemstvijamu.czPlease attach an invoice to the e-mail or indicate its number or order number.
  2. Return the goods in the original packaging. No amount will be refunded in the event of a violation of the trade mark on the bottles and the protective packaging of soaps. A reduced amount (20%) will be refunded in the event of a breach of the packaging box on the basis of the cost of putting the goods into its original state.
  3. Returned goods immediately (not on delivery) to the following address: Lenka Eliášová, Na Louži 1310/6, Praha 10, 101 00.
  4. The costs of returning the goods shall be borne by the buyer.
  5. If the goods have been paid by transfer to the account, the amount will be returned to the same account. In case of payment by card or delivery, please provide us with the account number to which you require the amount to be refunded.

RECOGNITION

– If the goods taken have shortcomings (e.g. they do not have agreed or justified expected characteristics, their quantity, degree, weight) these are defects of the goods for which the seller is responsible.

– The Seller is not obliged to comply with the Buyer’s claim if he proves that the Buyer has caused the defect of the goods or has caused it itself before taking over.

RECOGNITION PROCEDURE
  • Immediately after receiving the goods, inform the seller about any deficiencies by email to Lenka@tajemstvijamu.cz or by phone to +420 775 999 498. Add an invoice to your e-mail.
  • If the situation so requires, we will invite you to send the claimed goods by mail to the following address: Lenka Eliášová, Na Louži 1310/6, Praha 10, 101 00. Add a copy of the invoice to the shipment.
  • The Buyer is obliged to prove the purchase of goods (preferably proof of purchase or order number). The deadline for handling the complaint runs from handover/dressing the goods to the seller or to the place for repair. The goods should be packed in the appropriate packaging in order to avoid damage, should be clean and complete.
  • The seller is obliged, without delay, within three working days at the latest, to decide on the complaint or to decide that a professional assessment is necessary for the decision. The seller will inform the buyer of the need for professional assessment within this period. After this period, the buyer shall have the same rights as if it were a material breach of the contract.

SOLUTION OF SPORTS

– Mutual disputes between the seller and the buyer are settled by general courts.
– Buyer, who is a consumer, has the right under Act No. 634/1992 Coll., on Consumer Protection, as amended, to an out-of-court solution of consumer dispute from a purchase contract or from a service contract. The Czech Trade Inspection Authority is the subject entitled to carry out an out-of-court dispute resolution. More information is available on the website www.coi.cz.
– An out-of-court solution to the consumer dispute is initiated solely on a consumer’s proposal, only if the dispute has not been resolved directly with the seller. The proposal may be submitted no later than 1 year after the date on which the consumer has exercised his right to the seller for the first time.


– Spotřebitel má právo zahájit mimosoudní řešení sporu online prostřednictvím platformy ODR dostupné na webové stránce ec.europa.eu/consumers/odr/.


– Prodávající se zavazuje usilovat přednostně o mimosoudní řešení sporů s kupujícím, pokud je kupující neodmítne. Mimosoudní urovnání sporů lze provést také prostřednictvím služby VašeStížnosti.cz na webové stránce www.vasestiznosti.cz.


– This procedure is not a mediation under Act No. 202/2012 Coll., on mediation, as amended, nor an arbitration procedure under Act No. 216/1994 Coll., on arbitration and enforcement of arbitration findings, as amended, and its use is without prejudice to the party’s right to contact the Czech Trade Inspection or the Court.

– During the course of negotiations on an out-of-court settlement of the dispute, the limitation period and the exclusivity period under the Civil Code shall not run until one of the parties expressly refuses to continue the proceedings.

– Supervision of compliance with obligations under Act No. 634/1992 Coll., on Consumer Protection, as amended, carries out the Czech Trade Inspection (www.coi.cz).

FINAL PROVISIONS

– Buyer for the purposes of these business conditions means a consumer who is a person who, unlike the seller, does not act in the course of his business or in the course of his profession.

– For the purposes of these terms and conditions, a seller means an entrepreneur who, unlike the buyer, acts in the course of his business or in the course of his or her profession when concluding and fulfilling the contract.

– Other issues not mentioned here are governed by the Civil Code (No. 89/2012 Coll.), the Consumer Protection Act (No. 634/1992 Coll.) and other legislation, as amended.

– Contract and questions related to Czech law.
